Manual Reference:  Section 3345 & 3350

All TANF/FS applicants/recipients must participate in the work program unless exempt.  Any individual referred to TANF is considered to have met FS work requirements.

TANF EXEMPTIONS

Dependent child in AU who is not a parent

Note:  An 18 year old is not considered a child unless s/he is in school.

Child under 16

Child 16-17 and not the Head of AU

Single custodial parent of a dependent child under 12 months*

Note:  This exemption does not apply to parents who are under 20 and who do not have a high school diploma or its equivalent.  These parents are mandatory.

*This exemption may only be given once in a lifetime.

Person 60 or older
TANF Exceptions:

DFCS has made a decision not to work with the following parents at this time; although they are mandatory, a referral (Form 4) will not be completed.

  • Parents who receive SSI
  • Ineligible parents (e.g., non-citizen)
  • Parents who are penalized because they are felons or probation or parole violators
Student enrolled at least half time in a recognized school, training program, or institution of higher learning (see section 3245 of the policy manual for the definition of a student)
Caretaker of a dependent child under 6 (child does not have to be a member of the AU or live in the home as long as care is received in the AU's home)
Caretaker needed on a continuous basis to care for another individual due to mental or physical impairment (impaired individual does not need to be AU member or live in the home)
A person is physically or mentally incapacitated if one of the following descriptions applies.
  • temporarily ill/unfit for employment based on medical verification
  • receiving disability benefits (SSI, RSDI, 100% VA, Railroad Retirement, Worker's Compensation, etc.)
  • has an application pending for SSI
  • high risk pregnancy, verify by medical statement
Person is working (includes self-employment) an average of 30 hours a week, or earning weekly the equivalent of 30 hours at minimum wage
Seasonal farm worker who is under contract to begin work within 30 days
VISTA volunteer
Participant in a drug/alcohol treatment center
Receiving or applied for UCB
Remember, an individual who is referred for TANF work requirements is considered to have met FS work requirements and must be be coded as "exempt for FS as complying with TANF."
  A refugee student participating in a recognized refugee educational/training program at least half-time.
